Welcome to our website and thank you for your interest in our company. We take the protection of your personal data very seriously. We process your data in accordance with the applicable legal provisions for the protection of personal data, in particular the General Data Protection Regulation (DS-GVO) and the country-specific implementation laws applicable to us. With the help of this privacy policy, we inform you comprehensively about the processing of your personal data by EBERLE Controls GmbH and the rights to which you are entitled. 

Personal data is information that makes it possible to identify a natural person. This includes in particular name, date of birth, address, telephone number, e-mail address but also your IP address.

Anonymous data exists when no personal reference to the user can be made.

Your rights as a data subject

First, we would like to inform you at this point about your rights as a data subject. These rights are standardized in Art. 15 - 22 DS-GVO. This includes:

  • The right to information (Art. 15 DS-GVO),
  • The right to erasure (Art. 17 DS-GVO),
  • The right to rectification (Art. 16 DS-GVO),
  • The right to data portability (Art. 20 DS-GVO),
  • The right to restriction of data processing (Art. 18 DS-GVO),

Rights of objection

Please note the following in connection with rights of objection:

If we process your personal data for the purpose of direct marketing, you have the right to object to this data processing at any time without giving reasons. This also applies to profiling, insofar as it is related to direct advertising.

If you object to processing for direct marketing purposes, we will no longer process your personal data for these purposes. The objection is free of charge and can be made form-free, preferably to: datenschutz@eberle.de.

If we process your data for the protection of legitimate interests, you may object to this processing at any time on grounds relating to your particular situation; this also applies to profiling based on these provisions.

We will then no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims.

Purposes and legal bases of data processing

When processing your personal data, we comply with the provisions of the DS-GVO and all other applicable provisions of data protection law. Legal bases for data processing result in particular from Art. 6 DS-GVO.

We use your data to initiate business, to fulfill contractual and legal obligations, to implement the contractual relationship, to offer products and services, and to strengthen the customer relationship, which may also include analyses for marketing purposes and direct advertising.

Your consent to data processing may also constitute a permission requirement under data protection law. Before giving your consent, we will inform you about the purpose of the data processing and about your right of revocation.

Disclosure to third parties

We will only pass on your data to third parties within the framework of the statutory provisions or with the corresponding consent. Otherwise, we will not disclose your data to third parties unless we are required to do so by mandatory legal provisions (disclosure to external bodies such as supervisory authorities or law enforcement agencies).

Recipients of the data / categories of recipients

Within our company, we ensure that only those persons receive your data who need it to fulfill contractual and legal obligations.

In certain cases, service providers support our specialist departments in fulfilling their tasks. The necessary contractual framework under data protection law has been concluded with all service providers.

Third country transfer / third country transfer intention

Data is only transferred to third countries (outside the European Union or the European Economic Area) if this is necessary for the performance of the contractual relationship, is required by law or you have given us your consent to do so.

We do not transfer your personal data to any service provider outside the European Economic Area.

Storage period of data

We store your data as long as it is required for the respective processing purpose. Please note that numerous retention periods require that data continue to be stored. This applies in particular to retention obligations under commercial or tax law (e.g. Commercial Code, Fiscal Code, etc.). If there are no further storage obligations, the data is routinely deleted once the purpose has been achieved.

In addition, we may retain data if you have given us permission to do so or if legal disputes arise and we use evidence within the scope of statutory limitation periods, which can be up to thirty years; the regular limitation period is three years.

Secure transfer of your data

In order to best protect the data we store against accidental or intentional manipulation, loss, destruction or access by unauthorized persons, we use appropriate technical and organizational security measures. The security levels are continuously reviewed in cooperation with security experts and adapted to new security standards.

The exchange of data to and from our website is always encrypted. We offer HTTPS as the transmission protocol for our website, in each case using the current encryption protocols. In addition, there is the option of using alternative communication channels (e.g., the postal service).

Obligation to provide data

Various personal data are necessary for the establishment, implementation and termination of the debt relationship and the fulfillment of the associated contractual and legal obligations. The same applies to the use of our website and the various functions it provides.

We have summarized details of this for you in the above point. In certain cases, data must also be collected or made available due to legal requirements. Please note that it is not possible to process your request or carry out the underlying contractual relationship without providing this data.

Categories, sources and origin of data

Which data we process is determined by the respective context: this depends on whether, for example, you place an order online or enter an inquiry in our contact form, whether you send us an application or submit a complaint.

Please note that we may also provide information separately in a suitable place for special processing situations, e.g. when you upload application documents or submit a contact request.

When you visit our website, we collect and process the following data:

  • Name of the Internet service provider
  • Information about the website from which you are visiting us
  • Web browser and operating system used
  • Language and version of the browser software
  • The IP address assigned by your Internet service provider
  • Files requested, amount of data transferred, downloads/file exports
  • Information about the web pages you visit on our site incl. date and time
  • Time zone difference to Greenwich Mean Time (GMT)
  • Access status/HTTP status code
  • For reasons of technical security (in particular to defend against attempted attacks on our web server), this data is stored in accordance with Art. 6 Para. 1 lit. f DS-GVO. After 7 days at the latest, anonymization takes place by shortening the IP address so that no reference to the user is made.

In the context of a contact request by e-mail, we collect and process the following data:

  • Name, first name
  • Contact details
  • Salutation
  • Information on wishes and interests
  • Please specify all other data that will be collected and processed

For online applications, we collect and process the following data:

  • Name, first name
  • Address
  • Contact details
  • All other data that you send us as part of the application process.

For newsletters, we collect and process the following data:

  • Name, first name
  • E-mail-address
  • Salutation

Automated individual case decisions

We do not use any purely automated processing processes to bring about a decision.

Cookies (Art. 6 Abs. 1 S. 1 lit. a, f DS-GVO, § 25 Abs. 1, 2 TTDSG)

Our website uses so-called cookies. They serve to make our offer more user-friendly, effective and secure. Cookies are small text files that are stored on your terminal device and that your browser stores (locally). Cookies contain only pseudonymous, usually even anonymous data. Links Social Media

On our website you will find links to the social media services of Meta / Facebook, LinkedIn, YouTube and Instagram. You can recognize links to the websites of the social media services by the respective company logo. If you follow these links, you will reach the corporate presence of EBERLE Controls GmbH at the respective social media service. When you click on a link to a social media service, a connection to the servers of the social media service is established. This transmits to the servers of the social media service that you have visited our website. In addition, further data is transmitted to the provider of the social media service. These are, for example:

Contacting us by e-mail (Art. 6 para. 1 lit. a, b DS-GVO)

If you contact us by e-mail, we will process the personal data provided in the e-mail solely for the purpose of processing your request.

Newsletter (Art. 6 Abs. 1 lit. a DS-GVO)

A free newsletter can be subscribed to on our website. The e-mail address provided during the newsletter registration as well as your name will be used for sending the personalized newsletter.

Here, the principle of data economy and data avoidance is observed, as only the e-mail address and your name (first and last name) are marked as mandatory fields. For technical necessity as well as for legal protection, your IP address is also processed when ordering the newsletter.

For sending newsletters by e-mail, we use the so-called double opt-in procedure. This means that you will only receive advertising by e-mail if you have previously expressly confirmed that we should activate the newsletter service. This is done by sending you a notification e-mail and asking you to confirm that you would like to receive our newsletter at this e-mail address by clicking on a link contained in this e-mail.

You can, of course, unsubscribe at any time using the unsubscribe option provided in the newsletter and thus revoke your consent. Furthermore, it is also possible to unsubscribe from the newsletter at any time directly via our website.

To register for our press distribution list, you must enter your name (first and last name), your e-mail address. The principle of data economy is thus also observed for the press distribution list.

EBERLE Controls GmbH is interested in maintaining the customer relationship with you and in sending you information and offers about our products / services. Therefore, we process your data to send you relevant information and offers by e-mail.

If you do not wish this, you can object at any time to the use of your personal data for the purpose of direct marketing; this also applies to profiling, insofar as it is related to direct marketing. If you object, we will no longer process your data for this purpose.

Purpose and legal basis

We ourselves maintain the fan pages in order to communicate with visitors to these pages and to inform them about our offers in this way.

In addition, we collect data for statistical purposes in order to be able to further develop and optimize the content and to make our offer more attractive. The data required for this purpose (e.g. total number of page views, page activity and data provided by visitors, interactions) are processed by the social networks and made available to us.
